GENERAL TERMS AND CONDITIONS

PACKAGE TRAVEL AGREEMENT

INTRODUCTORY PROVISIONS

1.1. These General Terms and Conditions of the Package Travel Agreement (hereinafter referred to as: ”General Terms and Conditions”) are an integral part of the Package Travel Agreement (hereinafter referred to as: ”Agreement”) concluded between the travel organizer – EURO GUIDE Poreč, St. Portun 15, registered in the Trade Register in Poreč under Trade Registration Number: 98186566, Tax Identification Number: 25519056521 (hereinafter referred to as: ”Trade”) and the traveler, or rather the travel contractor when the travel contractor concludes the Agreement for the benefit of a third party as a traveler (hereinafter referred to as: ”Traveler”).

1.2. These General Terms and Conditions are in accordance with the Act. In addition to these General Terms and Conditions, the package travel program (hereinafter referred to as: ”Travel Program”) also forms an integral part of the Agreement. In the event of any inconsistency between these General Terms and Conditions and the provisions of the Agreement or the Travel Program, the provisions of the Agreement shall prevail, then the content of the Travel Program, and then the provisions of these General Terms and Conditions.

1.3. These General Terms and Conditions shall apply exclusively to package arrangements in which Obrt Euro Guide is the organizer. If Obrt Euro Guide mediates or sells the services of other travel agencies, the responsible travel organizer shall be indicated in the Agreement and the general terms and conditions of that organizer shall apply, which Obrt Euro Guide shall make available to the Traveler.

TRAVEL PROGRAM

2.1. The Travel Program shall form an integral part of the Agreement and shall contain the pre-contractual information for package arrangements prescribed by law, and may, if necessary, also contain other information that Obrt Euro Guide deems useful.

2.2. Obrt Euro Guide guarantees the implementation of the Travel Program according to the description published on the Obrt website. Obrt Euro Guide undertakes to fully implement the content of the Travel Program, except in the event of extraordinary circumstances such as war, riots, strikes, terrorist activities, sanitary disturbances, natural disasters, traffic accidents, sudden and unusual traffic jams, interventions by competent authorities, disruptions in the schedule and delays of means of transport, weather conditions, epidemics, pandemics and other circumstances beyond the control of Obrt Euro Guide and which directly affect a particular destination. In the event of disruptions in the travel destination during the execution of the Package Agreement, which disruptions cause the need to change the content of the Travel Program, but which disruptions are not of such a nature as to completely prevent the implementation of the Travel Program, Obrt Euro Guide undertakes to take all reasonable measures to ensure that the Travel Program is implemented in a manner and with content that most closely matches the content of the Travel Program published prior to the trip. In such cases, Obrt Euro Guide will be deemed to have fully implemented the Travel Program, despite the fact that the implemented Travel Program differs from that published prior to the start of the trip.

APPLICATION FOR RESERVATION AND CONCLUSION OF CONTRACT

3.1. The traveler can send his inquiry or application for the reservation of a package arrangement from the offer of Obrta Euro Guide via the contact form on the website of Obrta Euro Guide, by e-mail, telephone, other means of remote communication or through another authorized travel agency or trade that acts as an intermediary.

3.2. When applying for a reservation and before concluding the Agreement, the Traveler is obliged to provide accurate information and valid documentation necessary for organizing the trip. The traveler is solely responsible and guarantees that he has provided Obrt Euro Guide with correct information and valid documents, and in the event of any change in data or documents, the Traveler is obliged to provide Obrt Euro Guide with new information and/or documents without delay. If the Traveler does not submit data or documents in accordance with the terms and conditions of the Agreement, or if the Traveler provides incorrect data and/or documents contrary to the provisions of these General Terms and Conditions and the instructions of the Euro Guide Workshop, the Traveler will be deemed to have withdrawn the reservation application and will be liable for any damage that may be incurred by the Euro Guide Workshop.

3.3. After submitting the reservation application, the Euro Guide Workshop will issue the Traveler an Offer under which the Traveler undertakes to pay an advance payment of at least 40% of the total price of the arrangement to the Euro Guide Workshop transaction account within 24 hours of receiving the Offer. In the event that the Traveler fails to make an advance payment for the reservation within 24 hours of receiving the Offer, the Traveler will be deemed to have withdrawn the reservation application. The Euro Guide Workshop undertakes to process the reservation application and to notify the Traveler of the reservation confirmation in writing, as well as to provide the Traveler with a confirmation of the reservation payment. If Obrt Euro Guide is unable to confirm the reservation, Obrt Euro Guide is obliged to return the advance payment in full to the Traveler. If the Traveler does not accept the requested reservation, and confirmed by Obrt Euro Guide, Obrt Euro Guide has the right to retain the advance payment received for the reservation. In the event that the reservation is accepted by the Traveler, the reservation costs are included in the price of the package arrangement. Upl

The advance payment does not imply confirmation of the reservation, but the reservation is considered confirmed only upon written notification by Obrt Euro Guide. Obrt Euro Guide may, depending on the case, specify in the Travel Program a deposit payment for the reservation in a percentage greater or less than 40% of the total price of the package arrangement, and in that case this percentage will be expressed in the appropriate monetary amount in the Offer. In that case, the amount specified in the Offer will be relevant for Obrt Euro Guide’s obligation to make and confirm the reservation.

3.4. The Agreement is considered concluded: (i) after Obrt Euro Guide, in accordance with the given offer, within the period specified by Obrt Euro Guide, receives from the Traveler on the transaction account the amount of advance payment specified in the Travel Program, and if the same is not specified, at least 40% of the reservation value, and (i) after Obrt Euro Guide confirms the reservation. If the Traveler and Obrt Euro Guide conclude the Contract in writing, Obrt Euro Guide is obliged to hand over a copy of the signed Contract to the Traveler immediately after the Contract is signed by both contracting parties. If the Traveler and Obrt Euro Guide conclude the Contract via e-mail and/or website and/or by making an advance payment to Obrt Euro Guide’s account, Obrt Euro Guide is obliged to deliver a confirmation to the Traveler via e-mail within 24 (twenty-four) hours that the Contract has been concluded. .

3.5. By concluding the Contract, the Traveler confirms that he is fully familiar with all the characteristics of the selected trip, i.e. the Travel Program, and that he fully understands and accepts the Contract, the Travel Program and the General Terms and Conditions. If the Traveler contracts the trip on behalf of and for the account of other travelers, by concluding the Contract, he confirms that he has fully acquainted the other travelers with all of the above, and is personally responsible for ensuring that the other travelers in whose name and for whose account he has contracted the trip will comply with the provisions of the Contract, the Travel Program and these General Terms and Conditions. The Traveler also undertakes to inform other travelers of any additional information received in further contact with Obrt Euro Guide.

3.6. The Traveler is obliged to pay Obrt Euro Guide the remaining amount of the total package price no later than 30 days before the start of the trip. After payment of the remaining amount of the total package price, Obrt Euro Guide will issue an invoice to the Traveler for all payments made. If the remaining amount of the total package price is not paid within the agreed period, it will be considered that the Traveler has terminated the Agreement and in that case the provisions on termination of the Agreement by the Traveler from point 10 of these General Terms and Conditions will apply.

3.7. Unless otherwise specified, for individual travel inquiries, Obrt Euro Guide may charge a fee for preparing an offer. In the event of acceptance of the offer, the amount charged will be deducted from the total package price. In the event that the Traveler does not accept the prepared offer, Obrt Euro Guide retains the amount charged to cover the costs of preparing the offer.

PAYMENT

4.1. Unless otherwise specified in the Agreement or the Program, the Traveler may pay for services to Obrt Euro Guide by bank transfer to the business account of Obrt Euro Guide and/or by cards accepted by Obrt Euro Guide, and in cash. The Traveler shall bear all costs, fees and commissions incurred in connection with monetary transactions or card payments. The day of payment shall be the day when the Traveler’s payment is recorded on Obrt Euro Guide’s business account.

4.2. For all installment payments, Obrt Euro Guide charges handling costs in the amount of 5% of the agreed price.

PRICES

5.1. The price of the package arrangement is determined by the Travel Program and is stated in the Agreement and is valid from the date of publication of the Travel Program. The price includes Obrt Euro Guide services that are included in the Travel Program. The prices of the package arrangement are published in the official currency of the Republic of Croatia, EUR-o.

5.2.Unless otherwise agreed, the price of the package arrangement does not include additional services, such as optional excursions and visits, tickets, travel-related insurance costs, special services such as special meals, or any other services that are not included in the price of the package arrangement by the Travel Program. All such additional services that the Traveler chooses, he is obliged to pay additionally to Obrta Euro Guide according to the indicated price.In the event that the Traveler chooses additional services in terms of this point, Obrt Euro guide will issue a separate invoice for these additional services to the Traveler, which the Traveler undertakes to pay within the deadline set by Obrt Euro Guide. In the event that the Traveler does not pay for these services within the deadline, Obrt Euro Guide is not obliged to provide the Traveler with additional services.

5.3. Prices of additional services such as optional excursions and visits, ticket prices, insurance costs related to the trip, etc. listed in the Travel Program are based on contracts with our partners and may differ from the prices on the spot of the travel destination. Such a possible price difference cannot be the subject of a complaint against the Euro Guide Trade. For services that are paid for on the spot, any complaint should be submitted directly to the service provider.

5.4. Obrt Euro Guide has the right to sell package deals at special prices that are lower than the regular prices for the same trips. In such a case, the Traveler who has concluded a Package Deal at the regular price is not entitled to a reduction in the price of the package deal.

5.5. All applicable discounts are expressly stated in the Agreement. The available discounts on the price of the package deal are mutually exclusive and the Traveler may choose the discount that suits him best and for which he meets the conditions. The discount is calculated exclusively on the part of the price without mandatory or additional surcharges, i.e. on the part of the price from which port fees, other similar costs and additional and special services of meals, excursions, transportation, etc. are excluded.

5.6. Obrt Euro Guide does not approve a refund of the Traveler’s funds for any contracted service that the Traveler did not use through his own decision or fault.

CHANGE OF THE CONTRACTED PRICE

6.1.Obrt Euro Guide may, after concluding the Agreement, and no later than 20 days before the start of the trip, increase the agreed price in writing, if this is the result of a change in: (a) the price of passenger transport due to fuel costs or other energy sources, (b) the amount of taxes or fees for travel services covered by the Agreement determined by third parties not directly involved in the execution of the package, including tourist taxes, landing fees or embarkation or disembarkation fees at ports and airports, (c) applicable currency exchange rates. .

6.2. If it is an increase in the agreed total price of the package by up to 8%, Obrt Euro Guide may make the increase unilaterally, and the Traveler is obliged to accept it. In the event that the Traveler refuses to pay the difference in the amount of up to 8% of the increase in the total price of the package by no later than 3 days from the receipt of the notification, it will be considered that the Traveler has terminated the Agreement and in that case the provisions on termination of the Agreement by the Traveler will apply.

6.3. If the increase in the agreed total price of the package arrangement exceeds 8%, the Traveler has the right to terminate the Agreement, whereby the termination statement must be submitted in writing to Obrt Euro Guide within 2 days of receiving the notification. In the event of termination, the Traveler has the right to a refund of the amount paid without the right to compensation for damages and other costs. If the Traveler does not submit the termination to Obrt Euro Guide in writing or within the specified period, it is considered that he agrees to the price increase.

6.4. In the event that the possibility of a price increase has been agreed, the Traveler has the right to a price reduction corresponding to any reduction in the costs specified in point 6.1., and if such reduction occurs in the period from the conclusion of the Agreement to the start of the package arrangement. In such a case, Obrt Euro Guide is obliged to refund the difference in price to the Traveler, whereby Obrt Euro Guide is entitled to deduct the actually incurred costs from the refund amount owed to the Traveler and is obliged to present evidence of these costs to the Traveler at the Traveler’s request.

TRANSFER OF THE CONTRACT TO ANOTHER TRAVELER

7.1. Before the start of the trip, the Traveler may transfer the Contract to another Traveler who meets all the conditions applicable to that Contract and if such a change is possible and permitted under the terms and conditions of the service providers included in the package. The Traveler is obliged to notify Obrt Euro Guide of the intended transfer of the Contract in writing or on a durable medium no later than 7 days before the start of the trip. The Traveler to whom the Contract is transferred must give explicit consent to the transfer of the Contract via e-mail, thereby becoming a party to the contract. The Traveler who transferred the Contract to the new Traveler ceases to be a party to the contract and is not entitled to compensation for any damage or other costs.

7.2. The Traveler transferring the Contract and the Traveler to whom the Contract is transferred are jointly and severally liable to Obrt Euro Guide for all payments under the Contract, as well as for all possible additional fees, charges and other costs arising from the transfer of the Contract, of which Obrt Euro Guide will inform them.

7.3.For the transfer of the Contract to another Traveler, Obrt Euro Guide has the right to charge the Traveler transferring the contract the cost of transferring the Contract in the amount of 15 euros per person.

CHANGES TO THE TERMS OF THE CONTRACT

8.1. After concluding the Contract and before the start of the trip, Obrt Euro Guide may unilaterally change the terms of the Contract, if the change is insignificant, of which Obrt Euro Guide will notify the Traveler on a durable medium. An insignificant change is considered to be any change that does not significantly change the main characteristics of the travel services, does not reduce the quality or value of the package arrangement, nor does it cause significant inconvenience or additional costs for the Traveler, for example: changes in the schedule of tours, excursions and visits, etc.

8.2.If, before the start of the trip, Obrt Euro Guide is forced to significantly change any of the main features of the travel services, or if it is unable to fulfill the agreed special requirements of the Traveler, it is obliged to inform the Traveler without delay on a permanent data carrier about the proposed changes, their impact on the price of the package arrangement, or about the offered for

the replacement package and its price, as applicable. The Traveler is obliged to inform the Euro Guide Workshop on a durable medium within 2 business days of receiving the notification whether he accepts the proposed change or terminates the Contract. If the Traveler does not respond within the specified period, he is deemed to agree with the proposed changes or replacement package. If the changes or replacement package result in a higher price or additional costs, the Traveler is obliged to pay the difference in price. If the changes or replacement package result in a lower quality or price, the Traveler is entitled to an appropriate price reduction. If the Traveler terminates the Contract, the Traveler is entitled to a refund of the amount paid without the right to compensation for damages and other costs.

8.3.Obrt Euro Guide reserves the right to change the day or time of the trip due to a change in unforeseen circumstances, the right to change the direction of the trip if the travel conditions change (natural disasters or other situations that Obrt Euro Guide cannot influence) without compensation for damages, and in accordance with applicable domestic regulations. Obrt Euro Guide does not assume responsibility for changes due to unforeseen circumstances and force majeure during the trip. In such cases, it can provide appropriate services considering the situation.

TERMINATION OF THE CONTRACT BY THE TRAVELER

9.1. At any time before the start of the package arrangement, the Traveler may terminate the Contract by providing Obrt Euro Guide with a written notice of termination of the Contract on a durable medium. The Contract shall be deemed terminated on the day on which Obrt Euro Guide receives the written notice. In the event of termination, Obrt Euro Guide has the right to charge a standard fee for termination of the Contract in the amount determined according to the date of termination. The fee for terminating the contract is charged by withholding the appropriate amount of money that the Traveler paid as the price of the package. Unless otherwise specified, the amount of the fee is determined as follows:

GROUP DEPARTURES:

(i) travel within Croatia:

– up to 30 days before departure, Obrt Euro Guide retains 40% of the package price,

– 29 – 22 days before departure, Obrt Euro Guide retains 80% of the package price,

– 21 – 0 days before departure, Obrt Euro Guide retains 100% of the package price, or for a ”no show” or for interruption of the trip by the Traveler, Obrt Euro Guide retains 100% of the package price,

INDIVIDUAL DEPARTURES:

(a) travel within Croatia:

– more than 60 days before departure, Obrt Euro Guide retains a fixed fee in the amount of 50 euros,

– 60 – 46 days before departure, Obrt Euro Guide retains 15% of the package price,

– 45 – 31 days before departure, Obrt Euro Guide retains 40% package price,

– 30 – 16 days before departure, Obrt Euro Guide retains 80% of the package price,

– 15 – 0 days before departure, Obrt Euro Guide retains 100% of the package price,

– after departure, i.e. for a ”no show” 100% of the package price;

– in the event that on the day of departure it is determined that the passenger provided incomplete and/or incorrect information about the validity of travel documents when applying for a reservation and/or provided information about invalid travel documents in accordance with the provisions of point 16 of these General Terms and Conditions, and therefore is prevented from departing, Obrt Euro Guide retains 100% of the package price.

9.2. The traveler has the right to terminate the Contract before the start of the package tour without paying any termination fee and with the right to a refund of the paid package tour price in the event of force majeure or extraordinary circumstances that could not be avoided, which occurred at the destination or in its immediate vicinity and which significantly affect the fulfillment of the package tour or which significantly affect the transportation of passengers to the destination.

These cases include: war in the country of travel destination, epidemics and/or pandemics of diseases in the country of travel destination against which vaccination is not possible in the country of departure, which seriously endanger the life and health of the Traveler, natural disasters that have affected the destination or the immediate surroundings of the destination within the country of travel destination, which directly endanger the life and health of persons staying in the area of ​​the destination within the country of travel destination, terrorist activities, sanitary disturbances in the destination within the country of travel destination that significantly complicate and/or prevent the fulfillment of obligations under the package arrangement, and public unrest that has affected the destination within the country of travel destination, which are of such proportions that they affect the safety of the Traveler’s stay in the country of destination in such a way that the Traveler’s stay in that destination would be dangerous to the life and health of the Traveler.

For the avoidance of doubt, in order for the Traveler to exercise the right from this point, the aforementioned circumstances must be such that they significantly affect the fulfillment of the package arrangement or the transportation of the Traveler to the destination.

9.3.If the Traveler wishes to cancel the trip during the realization of the trip, he/she may do so by delivering a written notice to the Euro Guide Workshop, and the termination of the Contract shall take effect immediately.

In such a case, the Traveler is not entitled to a refund of any funds, but in such a case Obrt Euro Guide has the right to retain 100% of the total price of the package arrangement, and the Traveler is in such a case obliged to bear the costs of repatriation and all other costs in connection therewith.

9.4. In the event of termination of the Contract by the Traveler for any reason, the Traveler is not entitled to a refund of any costs incurred in connection with the trip.

9.5. If the actual costs arising from the termination of the Contract by the Traveler exceed the above-mentioned standard fees for termination of the Contract, Obrt Euro Guide reserves the right to charge up to the full amount of the actual costs incurred. The Traveler is solely responsible for any costs or damage that may arise, both to Obrt Euro Guide and to other travelers and third parties.

TRAVEL INSURANCE – RECOMMENDATION FOR EVERY TRIP

10.1 By signing the Package Agreement, of which these General Terms and Conditions are an integral part, it is considered that additional insurance has been offered and recommended to the passengers, namely: insurance against the consequences of an accident and illness during the trip, insurance in the event of trip cancellation and insurance covering the costs of assistance and the return of the passenger to the place of departure in the event of an accident and illness, as well as that the Passenger has been provided with information on the content of these insurances and the general terms and conditions of the insurance contract. In the event that the passenger requests the aforementioned insurances, they can be contracted directly with one of the insurers or with Obrt Euro Guide, with Obrt Euro Guide acting only as an intermediary. Trip cancellation insurance, according to the terms and conditions of the insurance company, is contracted when concluding the Travel Agreement and cannot be contracted subsequently with Obrt Euro Guide. If the passenger does not submit the information for the preparation of the insurance policy within the deadline specified in the offer, it is considered that the passenger does not want travel insurance or will contract it independently. The insurance premium is calculated depending on the value of the trip, and according to the price list of the insurance company. Unforeseen obstacles as a reason for trip cancellation are determined by each insurance company in accordance with its terms and conditions. In the event of trip cancellation, the amount of the paid premium for cancellation insurance is not refunded. If the traveler has to cancel the trip, Obrt Euro Guide reserves the right to charge an appropriate fee according to the rules of the general terms and conditions. Other insurance terms and conditions are included with the insurance policy that will be sent or delivered to the travelers.

10.2. In order to avoid any doubt, in the event of contracting insurance, the general terms and conditions of the individual insurer will apply exclusively to the said insurance, which will be attached to the insurance offer as well as to the insurance policy in the event of insurance realization.

TERMINATION OF THE CONTRACT BY OBRTA “EURO GUIDE”

11.1. If the number of people registered for the package-arrangement is less than the minimum number specified in the Travel Program, Obrt Euro Guide may terminate the Contract before the start of the trip. In such case, Obrt Euro Guide will refund the payments received for the package arrangement to the Traveler, without any obligation to compensate for damages or make any other payments to the Traveler. Obrt Euro Guide will notify the Traveler of the termination within the period specified in the Agreement, but no later than:

– 20 days before the start of the package arrangement for trips lasting more than six days,

– seven days before the start of the package arrangement for trips lasting between two and six days.

– 48 hours before the start of the package arrangement for trips lasting less than two days.

11.2. If a sufficient number of passengers have not registered for the package arrangement, Obrt Euro Guide reserves the right, if the conditions of the individual package arrangement allow, to realize the trip with a smaller number of passengers than the prescribed minimum. If applicable, Obrt Euro Guide will submit a new price offer to the registered Travelers based on the calculation.

11.3.Obrt Euro Guide may terminate the Agreement before the start of the package arrangement if Obrt Euro Guide is prevented from executing the Agreement by extraordinary circumstances that could not be avoided. In this case, Obrt Euro Guide will notify the Traveler of the occurrence of these circumstances and termination without delay and return the payments received for the package-arrangement, without the obligation of compensation for damages or any other payments to the Traveler.

11.4. If Obrt Euro Guide is forced to terminate the Agreement during the realization of the trip, the Traveler has the right to return exclusively the funds related to the unused part of the contracted services.

11.5. In any case of termination of the Agreement by the Euro Guide Trade, the Traveler is not entitled to a refund or collection of any travel insurance costs, testing, costs, fees and commissions incurred in connection with monetary transactions or card payments and other costs.

11.6. Obrt Euro Guide may terminate the Contract during the implementation of the trip if the Traveler’s actions endanger, hinder or prevent the regular implementation of the Travel Program or cause damage to Obrt Euro Guide, service providers, other travelers,

third parties or property. In that case, the provisions of these General Terms and Conditions that apply to the termination of the Agreement by the Traveler will apply, and Obrt Euro Guide also reserves the right to claim damages from the Traveler.

11.7. If the trip is canceled by the tour operator for whom Obrt Euro Guide acted as an intermediary in the sale of the aforementioned arrangement, Obrt Euro Guide will inform the Traveler of the actions of the tour operator regarding the cancellation of the agreement. In that case, the Traveler exercises all rights from the package arrangement agreement directly with the tour operator in accordance with its general terms and conditions with which the Traveler is familiarized when purchasing the package arrangement.

TRAVEL TERMS AND CONDITIONS FOR LINKED TRAVEL ARRANGEMENTS

12.1. A linked travel arrangement implies at least two different types of travel services purchased for the purposes of the same trip or vacation that do not constitute a package arrangement (e.g. individual hotel reservations, airline tickets, transfers and similar additional services).

12.2.The general terms and conditions of travel for package travel arrangements do not apply to travel in a linked travel arrangement, except for the part of protecting passengers in the event of insolvency of Obrt Euro Guide.

12.3. When traveling in linked travel arrangements, Obrt Euro Guide acts on behalf of and for the account of the service provider, i.e. as an authorized sales agent of various service providers (airlines, hotels, transfers, tourist service reservation agencies, etc.) and each of the Service Providers is solely responsible for the proper performance of its services in accordance with the contract.

12.4. When traveling in linked travel arrangements, Obrt Euro Guide will inform the Traveler about the terms and conditions of these service providers, and by purchasing an individual service in a linked travel arrangement, the Traveler accepts the general terms and conditions of the individual service provider.

OBLIGATIONS OF OBLIGATIONS OF EURO GUIDE

13.1. Unless otherwise specified, Obrt Euro Guide will provide the services from the package arrangement in Croatian, German, Italian and English.

13.2. Obrt Euro Guide undertakes to duly fulfill its obligations arising from the Law, in particular the obligation to maintain business secrets, the obligation to offer insurance, the obligation to inform the Traveler about the liability insurance policy, the obligation to correct non-conformities, the obligation in the event of the inability to perform a significant part of the travel services, the obligation to bear the costs of necessary accommodation, the obligation to reduce the price and compensate for damage, the obligation to provide assistance.

13.3. In addition to the prescribed obligation to provide assistance, if the Traveler is assisted by the tour leader or another representative of Obrt Euro Guide, the assistance will be provided in a way that does not affect the regular course of the Travel Program, or to the detriment of other Travelers. All costs incurred in connection with the provision of assistance shall be borne by the Traveler.

13.4. Obrt Euro Guide is obliged to correct any non-conformity that arises if any of the travel services cannot be performed in accordance with the package travel contract, and in accordance with the provisions of these General Terms and Conditions. Obrt Euro Guide shall not be obliged to correct non-conformities that cannot be corrected or if the correction of the non-conformity would cause disproportionate costs taking into account the extent of the non-conformity and the value of the travel services affected by the non-conformity. If Obrt Euro Guide does not correct the non-conformity for the reasons stated in the previous point, the Traveler is entitled to a price reduction and compensation for damages.

OBLIGATIONS OF THE TRAVELER

14.1. Responsibility of the Traveler for other travelers

The Traveler is obliged to inform all other travelers from his application for the reservation of the package arrangement of the Contract, the Travel Program and these General Terms and Conditions, and by paying the advance payment, the Traveler expressly confirms to Obrt Euro Guide that he has fulfilled this obligation. The Traveler is also obliged to inform other travelers of any additional information he receives in further contact with Obrt Euro Guide.

By applying for a package booking, the Traveler expressly confirms to Euro Guide that he is authorized to act on behalf of and for the account of all travelers included in the application and that he is fully responsible to Euro Guide for their compliance with the Agreement.

Unless otherwise specified, the Traveler is obliged to make all payments under the Agreement for all travelers included in the package booking application. Unless otherwise specified, each individual payment under the Agreement is distributed equally in percentages as a payment made for each traveler included in the package booking application.

Whenever the Traveler makes any statement, warranty, waiver or assumes any obligation, he is personally responsible for ensuring that each traveler from his package booking application will adhere to the same statements, warranties, waivers and fulfill the same obligation. Whenever such other traveler makes any statement, warranty, waiver or assumes any obligation, he is deemed to do so in his own name and for his own account.

14.2. Obligation to submit data and documents

When applying for a reservation of a package arrangement, the Traveler is obliged to submit to Obrt Euro Guide all the correct information and documents of all passengers that are necessary for the organization and implementation of the trip. Delivery

The data and documents provided must correspond to valid personal documents that will be used during the travel. Obrt Euro Guide is not responsible for the receipt, use or forwarding of incorrect or incomplete data or documents. A traveler who provides Obrt Euro Guide with incorrect or incomplete data or documents during the registration process is responsible for all consequences and costs arising from the use of such data or documents. In such a case, Obrt Euro Guide may terminate the Agreement with effect as if it had been terminated by the Traveler and demand payment of all incurred costs and damages from the Traveler. In the event that the Traveler fails to submit data or documents in accordance with the terms and conditions of the Agreement, the Agreement shall be deemed to have been terminated, in which case the provisions on termination of the Agreement by the Traveler shall apply.

In the event of any change in the traveler’s data that is necessary for the organization and implementation of the trip or the documents that the travelers will use during the travel, the Traveler is obliged to submit new data or documents to Obrt Euro Guide without delay. Otherwise, it is considered that he/she has submitted incorrect data or documents and the rules that apply to the submission of incorrect data or documents will apply.

If necessary for the organization and implementation of the trip, Obrt Euro Guide may retain copies of the traveler’s documents.

The traveler is obliged to check all travel documentation that Obrt Euro Guide delivers to him/her. If the Agency does not receive a complaint or request for correction from the Traveler within 24 hours of the delivery of the travel documentation, all travel documentation will be considered valid and correct. The costs incurred upon the request or need for any change or correction of the travel documentation after the expiry of that period shall be borne by the Traveler.

14.3. Obligation to comply with regulations

The traveler is obliged to inform himself/herself and comply with all valid regulations on travel documents and other applicable regulations, and to ensure that he/she, his/her documents and luggage comply with the conditions stipulated by the aforementioned regulations of the home country, the country of transit and the country of destination.

If the Traveler is prevented from embarking on the trip or continuing the trip due to non-compliance with the regulations, it will be considered that he has terminated the Contract, in which case the provisions on termination of the Contract by the Traveler apply. In such a case, the Traveler is also responsible for all costs and consequences incurred.

14.4. Travel documents

For the purpose of travel, the Traveler is required to have a valid passport or other appropriate valid document on the basis of which he can be granted entry into a particular country, all in accordance with the applicable regulations on travel documents. The Traveler is required to independently obtain at his own expense and have a valid passport or other travel document on the basis of which he can be granted entry into a particular country throughout the entire trip. Unless otherwise specified in the Travel Program, the minimum validity of the passport is six months from the date of departure from the country to which or through which he is traveling. The Traveler is responsible for his/her own passport or other travel document and is responsible for its possession, correctness and for all consequences that may arise from not having or using an invalid passport or other document.

If during the trip the Traveler’s passport or other appropriate document is stolen, destroyed, lost or otherwise misappropriated, the Traveler is obliged to obtain a new passport or other appropriate document at his/her own expense if this is necessary for the continuation of the trip or return to the country of departure. In doing so, the tour leader or other representative of the Euro Guide Trade may assist the Traveler, but not to the detriment of the regular implementation of the Travel Program. In addition to the costs of obtaining new documents, the Traveler is obliged to bear all additional costs and fees arising from the described situation.

If the Traveler has to interrupt the trip due to theft, destruction, loss or any other misappropriation of the passport or other appropriate document, he/she is not entitled to a refund of the paid trip or any compensation for expenses. In this case, the Traveler will be deemed to have terminated the Agreement and the provisions on termination of the Agreement by the Traveler will apply. In this case, the Traveler is also liable for all costs and damages incurred.

14.5. Vaccination and other health conditions of travel

If, in order to organize and implement the trip, it is mandatory to obtain an appropriate health document, undergo vaccination or fulfill any other condition specified by health regulations (e.g. obtaining a certificate of recovery from a certain disease, a certificate that the Traveler has never had a certain disease, vaccination certificates, negative PCR test, etc.), the Traveler is obliged to fulfill the required condition independently at his own expense and within the period specified in the Travel Program.

Obrt Euro Guide is not authorized to give instructions and recommendations to the Traveler to receive a certain vaccine, undergo a medical procedure or use medication, but for the purpose of obtaining all information, instructions and recommendations on these issues, it directs the Traveler to contact an authorized person. Obrt Euro Guide does not

is responsible for the consequences that may arise for the Passenger from vaccination, other medical procedures, use of medications and similar actions.

If the Passenger is prevented from embarking on the trip or continuing the trip due to not having an appropriate health document, not being vaccinated or not fulfilling another condition specified by health regulations, it will be considered that he has terminated the Contract, in which case the provisions on termination of the Contract by the Passenger apply. In such a case, the Passenger is also liable for all costs and damages incurred.

14.6. Carrier’s conditions

The Passenger is obliged to ensure that he personally, his documents and luggage meet the conditions set by the carrier.

Obrt Euro Guide is not responsible for the carrier’s decisions denying the Passenger transportation, nor for the costs or other consequences arising from such decisions. If the Passenger is unable to embark on or continue the trip due to such a decision, it will be considered that he has terminated the Contract, in which case the provisions on termination of the Contract by the Passenger apply. In such a case, the Traveler is also responsible for all incurred costs and damages.

14.7. Obligation to inform about circumstances affecting the trip

The Traveler is obliged, upon registration and at any time after the registration for the package arrangement reservation, to inform Obrt Euro Guide about all circumstances related to the health status and habits of all travelers included in his application for the package arrangement reservation if such circumstances could endanger or significantly complicate the realization of the trip or the health and life of the Traveler, such as the need for a special diet, information about chronic diseases, allergies, disability, etc.

Obrt Euro Guide will forward the Traveler’s request for a special type of diet to the service providers upon receipt of the request, but is not responsible for failure to fulfill the request in the event that they are unable to offer the requested type of meal or if the service providers make omissions when implementing the request.

The travel program may require that the Traveler meet certain conditions regarding personal characteristics, such as a certain age, a certain health status, a certain physical fitness, etc. In this case, the Traveler can use the services of Obrta Euro Guide only if he meets the set conditions. The traveler is obliged to provide Obrt Euro Guide with accurate information about the conditions set in this way. If the Traveler does not meet the conditions set in this way, or if he has provided incorrect information to Obrt Euro Guide, Obrt Euro Guide may terminate the Agreement with the effect that it was terminated by the Traveler and require payment of all incurred costs and damages from the Traveler.

14.8. Obligation to report non-compliance

The traveler is obliged, without undue delay and taking into account the circumstances, to inform Obrt Euro Guide of any non-compliance that he finds during the performance of the travel service covered by the package travel contract.

14.9. Passenger behavior at the destination

The traveler is obliged to comply with all the rules and house rules of the accommodation facility, especially regarding the time of starting to use the accommodation unit (check-in), the time of leaving it (check-out), as well as regarding the use of the accommodation unit and other contents of the accommodation facility. Unless otherwise specified, check-in and check-in can be done after 14:00 (or 16:00) on the day of arrival, and leaving the accommodation and check-out must be done no later than 10:00 on the day of departure, unless individual accommodation facilities have different rules for entering and leaving the accommodation. When possible, Obrt Euro Guide, in cooperation with the accommodation facility, will try to ensure group check-in earlier than officially scheduled, which will depend on the availability and occupancy of the accommodation facility on the day of check-in. If the check-in and check-out times for an individual accommodation facility are different from those listed here, the Traveler will be informed of this directly by the accommodation facility when checking in to the accommodation facility.

If the Traveler in any way endangers the safety, peace or comfort of other Travelers, third parties or endangers, hinders or prevents the regular running of the Travel Program, Obrt Euro Guide has the right to terminate the trip for that Traveler, in which case the Traveler is not entitled to compensation or a refund of any funds paid for the trip, and is also responsible for compensation for damages that may arise from his actions. In the event that such a traveler is a minor, the Traveler responsible for such a person is obliged to ensure the return of the minor traveler home at his own expense.

The Traveler undertakes to comply with all reasonable instructions of the tour leader or other representative of Obrt Euro Guide. In the event of any dissatisfaction, the Traveler is obliged to cooperate in good faith with the tour leader or other representative of Obrt Euro Guide and to try to resolve the matter of dissatisfaction without disturbing other Travelers, third parties, or damaging the reputation of Obrt Euro Guide.

The traveler is obliged to comply with the rules on personal safety to the extent that any average person would apply. The Agency is not responsible for the actions of the Traveler regarding his personal responsibility.

In the event of any breach of the Agreement or positive regulations, the Traveler is responsible for the damage caused as well as for any other damage caused and suffered by Obrt Euro Guide, another traveler, service providers or third parties. The Traveler will settle any damage caused on the spot directly to the person to whom the damage was caused. For any such damage that Obrt Euro Guide might settle on his behalf, Obrt Euro Guide has the right of recourse upon return from the trip. In the event of a breach of the Agreement or positive regulations and the damage caused by the Traveler, the joint and several liability of all travelers on the same reservation application for its compensation is determined.

LUGGAGE

The transportation of luggage is regulated by the conditions of the individual carrier. The transportation of luggage up to a certain weight, determined by the carrier, is free of charge. Obrt Euro Guide does not assume responsibility for lost or damaged luggage. The Passenger shall submit reports for lost luggage to the carrier or hotel. In the event of loss of luggage at the hotel, the Passenger shall submit the request to the hotel where the luggage was lost. We recommend paying for a luggage insurance policy.

COMPLAINT RESOLVING

The Passenger has the right to complain about the unfulfilled contracted service. The Passenger is obliged to file a written complaint with Obrt Euro Guide within 8 days of the end of the trip. Complaints filed after the deadline will not be taken into consideration. It is the obligation and in the interest of the Passenger to act in good faith and express the will to resolve the complaint during the trip and to send his written complaint to the service provider on site (reception, carrier, caterer or Obrt Euro Guide at the destination) and request a written confirmation from the service provider that he has received the complaint. Each Passenger shall file a complaint separately. Obrt Euro Guide will not consider group complaints. Obrt Euro Guide is obliged to respond to the complaint in writing within 15 days of receiving the complaint. If necessary, in order to collect information and verify the allegations from the complaint, Obrt Euro Guide can postpone the deadline for giving an answer for another 15 days, of which it is obliged to inform the Traveler who submitted the complaint in writing. Obrt Euro Guide will resolve only those complaints for which the Traveler provides proof that he sent a written complaint to the service provider on the spot and that the cause could not be eliminated on the spot. If, due to the fault of Obrta Euro Guide, the Program or part of the services were not fulfilled, the Traveler has the right to compensation in the amount of the actual value of the unused services. In the case of concluding a contract according to the “Fortuna system” or according to the “Last minute offer”, the passenger has no right to object to the trip. Until Obrt Euro Guide gives a written response to the complaint, the Traveler waives mediation by any other person, arbitration by UHPA, judicial institution or providing information to the media. The Traveler and Obrt Euro Guide will try to resolve all disagreements amicably, according to the prescribed procedure, and if this is not possible, the jurisdiction of the court in Poreč and the application of Croatian law are agreed upon, with the exception of the provisions of private international law.

PROTECTION OF PERSONAL DATA

The Traveler provides personal data voluntarily. The Traveler’s personal data is necessary in the process of realizing the contracted arrangements and will be used for further communication. Obrt Euro Guide undertakes not to transfer the Traveler’s personal data out of the country, except for the purpose of realizing the contracted arrangements. Exceptions to providing personal data to third parties relate to:

– contracting travel insurance policies, or if the Traveler concludes an insurance policy, then his personal data will be forwarded to the insurance company.

protecting the legitimate interests of Obrt Euro Guide.

The Traveler’s personal data will be stored in a database, in accordance with the decision of Obrt Euro Guide on the method of collecting, processing and storing personal data.

The traveler agrees that his/her data may be used for the purpose of marketing campaigns by Obrt Euro Guide.

The traveler may at any time withdraw his/her consent to the processing of his/her data for the purpose of marketing campaigns by Obrt Euro Guide.

GIFT VOUCHERS

A gift voucher is a means of payment in paper form, numbered with a unique number upon issuance. Obrt Euro Guide issues it with a payment made by the user and the amount of which is determined by the user. The gift voucher can be used for a trip of your choice from Obrt Euro Guide’s offer. The amount on the gift voucher is valid until the date stated on the gift voucher; after the expiry of the period, the amount on the gift voucher cannot be used. It is not possible to withdraw the already paid amount on the gift voucher. By paying the amount, the user accepts the provisions of these General Terms and Conditions governing the gift voucher and is deemed to be familiar with them.

Obrt Euro Guide has the right to amend these General Terms and Conditions in

at any time by publishing the amended text of the General Terms and Conditions on the Euro Guide Craft website.

If any provision of the Agreement or these General Terms and Conditions becomes null, invalid or unenforceable, this shall not affect the validity or enforceability of the remaining provisions of the Agreement and the General Terms and Conditions. Any such null, invalid or unenforceable provision shall be deemed to be replaced by an appropriate provision that is in accordance with the economic purpose and objective and, to the extent legally permissible, closest to the original intention of the Euro Guide Craft and the Traveler.

These General Terms and Conditions shall enter into force on the date of publication on the Euro Guide Craft website and shall supersede all previous conditions and travel instructions.
